Legal Agreement Governing Your Use of Beaconfield.space

Introduction

Welcome to Beaconfield Group LLC (“Beaconfield,” “Company,” “we,” “us,” “our”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” “your”) and Beaconfield Group LLC regarding your access to and use of our website beaconfield.space (the “Site”) and any purchase of products through the Site.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SITE OR PURCHASING OUR PRODUCTS. BY ACCESSING THE SITE, PLACING AN ORDER, OR OTHERWISE INDICATING YOUR ACCEPTANCE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL TERMS, DO NOT USE THE SITE OR PURCHASE PRODUCTS FROM US.

Beaconfield Group LLC is a limited liability company organized under the laws of the State of New Mexico, United States.

Article 2: Definitions

Throughout these Terms, the following definitions apply:

  • “Site” means beaconfield.space and all associated web pages, content, and functionality.

  • “Products” means bedding items including but not limited to bed sheets, blankets, duvet covers, and pillowcases offered for sale on the Site.

  • “Order” means a purchase request submitted by you through the Site.

  • “Confirmation Email” means the email sent to you after we receive and process your Order.

  • “Shipping Confirmation” means the email sent when your Order has been dispatched, containing tracking information.

  • “Parties” means collectively Beaconfield Group LLC and you.

  • “Force Majeure” means events beyond reasonable control including natural disasters, war, terrorism, strikes, pandemics, government actions, and technical failures.

Article 3: Eligibility & Account Registration

3.1 Age Requirement

By using our Site or purchasing Products, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction). Individuals under 18 may only use the Site with parental or guardian supervision.

3.2 Account Creation

You may browse the Site without creating an account. However, to place an Order, you must either:

  • Create a customer account, or

  • Check out as a guest

When creating an account, you agree to:

  • Provide accurate, current, and complete information

  • Maintain the security of your password (we encrypt but cannot control your password practices)

  • Accept responsibility for all activities under your account

  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

3.3 Accuracy of Information

You warrant that all information provided to Beaconfield Group LLC – including your name, address, email, phone number, and payment details – is truthful, accurate, and complete. Providing false information constitutes a material breach of these Terms.

Article 4: Product Information & Pricing

4.1 Product Descriptions

We strive to ensure product descriptions, images, specifications, and dimensions are accurate. However, we do not warrant that:

  • Product images precisely match actual colors (monitor settings vary)

  • Dimensions are exact to the millimeter (minor variations are normal in textile manufacturing)

  • Descriptions are error-free (typographical errors may occur)

If a Product is materially different from its description, your sole remedy is a refund under our Return Policy.

4.2 Pricing

All prices displayed on beaconfield.space are in United States Dollars (USD) unless otherwise indicated. Prices are subject to change without notice. However, once you place an Order, the price is locked in (subject to payment processing errors).

Typographical Errors: In the event a Product is listed at an incorrect price due to typographical or system error, we reserve the right to:

  • Cancel your Order and issue a full refund, or

  • Contact you to offer the Product at the correct price

4.3 Taxes

US Customers: Applicable sales tax will be calculated at checkout based on your shipping address and current tax laws.

International Customers: You are solely responsible for any import duties, customs fees, VAT, or other taxes imposed by your country. We do not collect these charges, and they are not included in our prices or shipping fees.

4.4 Promotions & Discount Codes

From time to time, we offer promotional codes. By using a discount code, you agree to:

  • Use only one code per transaction (unless explicitly stated otherwise)

  • Comply with any expiration dates or minimum purchase requirements

  • Not share codes publicly (unless intended for general distribution)

We reserve the right to cancel orders using fraudulent, expired, or unauthorized codes.

Article 5: Orders & Payment

5.1 Order Process

  1. Submission: You submit an Order through the Site.

  2. Acknowledgement: We send an automated acknowledgement email (this is not acceptance).

  3. Acceptance: We accept your Order by sending a Confirmation Email. A contract is formed at this moment.

  4. Fulfillment: We process, pack, and ship your Order.

We reserve the right to reject any Order for any reason, including:

  • Product unavailability

  • Suspicion of fraudulent activity

  • Pricing errors

  • Shipping restrictions to your location

  • Violation of these Terms

5.2 Payment Methods

We accept payment through Stripe as detailed in our Payment Methods policy. You authorize us to charge your selected payment method for the total Order amount (including shipping and taxes).

5.3 Order Cancellation by Customer

You may cancel your Order without penalty only if you contact us before we have started processing it (typically within 2 hours of submission). After processing begins, you must follow our Return Policy.

5.4 Order Cancellation by Beaconfield

If we cancel your Order, we will notify you and issue a full refund to your original payment method within 5 business days.

Article 6: Shipping & Delivery

6.1 Shipping Policy

Shipping terms are governed by our Shipping Policy (available at beaconfield.space/shipping), which is incorporated into these Terms by reference.

6.2 Delivery Timeframes

Estimated delivery times are provided as estimates only and are not guaranteed. We are not liable for delays caused by:

  • Carriers (USPS, FedEx, UPS, DHL, etc.)

  • Weather, natural disasters, or Force Majeure

  • Customs clearance (international orders)

  • Incorrect shipping information provided by you

6.3 Risk of Loss

Title and risk of loss pass to you when the carrier accepts the package. We are not responsible for lost or stolen packages after delivery confirmation. If a package is marked “delivered” but you have not received it, contact the carrier immediately.

6.4 International Shipping

You are responsible for complying with your country’s import laws. We are not liable if customs seizes or delays your package.

Article 7: Returns, Refunds & Warranties

7.1 Return Policy

Returns are governed by our Refund and Return Policy (available at beaconfield.space/returns), incorporated into these Terms. Key provisions:

  • 30-day return window from delivery date

  • Products must be unused, unwashed, with original tags

  • Customer pays return shipping (unless our error)

7.2 Limited Warranty

We offer a 1-year limited warranty against manufacturing defects. This warranty excludes normal wear and tear, improper care, and damage from misuse.

7.3 Disclaimer of Other Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEACONFIELD GROUP LLC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some states do not allow limitations on implied warranties, so this limitation may not apply to you.

Article 8: Limitation of Liability

8.1 No Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BEACONFIELD GROUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR PERSONAL INJURY.

8.2 Maximum Liability

Our total aggregate liability to you for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the specific Product giving rise to the claim.

8.3 No Liability for Sleep Quality

We provide bedding products. We do not guarantee improved sleep quality, health benefits, or any specific outcomes. Individual results vary based on numerous factors beyond our control.

8.4 Essential Purpose

These limitations apply even if a remedy fails of its essential purpose.

Article 9: User Conduct & Prohibited Activities

9.1 Permitted Use

You may use the Site for lawful purposes only, including:

  • Browsing Products

  • Making legitimate purchases

  • Leaving honest reviews

  • Contacting customer service

9.2 Prohibited Activities

You shall NOT:

  • Harvest or scrape data – Use bots, crawlers, or automated tools to extract content

  • Interfere with Site operations – Introduce viruses, DDoS attacks, or overloading requests

  • Reverse engineer – Decompile or attempt to derive source code

  • Create fake accounts – For fraudulent reviews, fake orders, or abuse of promotions

  • Resell Products – Purchase for commercial resale without written permission

  • Violate laws – Use the Site for any illegal purpose

Violation may result in immediate account termination and legal action.

  • Modifying or creating derivative works

10.3 Trademarks

“Beaconfield Group LLC,” the Beaconfield logo, and all product names are trademarks of Beaconfield Group LLC. You may not use these marks without written permission.

10.4 User-Generated Content (Reviews)

If you submit a product review, photo, or other content, you grant us a perpetual, irrevocable, royalty-free license to:

  • Display, modify, and distribute your content

  • Use your content for marketing purposes

  • Edit for length or clarity (without altering meaning)

You represent that you own the content or have permission to share it.

Article 11: Dispute Resolution & Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES INDIVIDUAL ARBITRATION INSTEAD OF COURT PROCEEDINGS.

11.1 Initial Dispute Resolution

Before initiating arbitration, you agree to contact us at phuongnm0198@gmail.com to attempt to resolve the dispute informally. We will work in good faith to resolve your concerns within 30 days.

11.2 Binding Arbitration

If the dispute cannot be resolved informally, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Albuquerque, New Mexico, unless the parties agree otherwise.

11.3 No Class Actions

YOU AGREE TO ARBITRATE DISPUTES ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.

11.4 Exceptions

Either party may bring an individual action in small claims court (for disputes within that court’s jurisdiction) without violating this arbitration agreement.

11.5 Governing Law

These Terms and any dispute arising from them shall be governed by the laws of the State of New Mexico, without regard to conflict of law principles.

11.6 Statute of Limitations

Any claim arising from these Terms must be filed within one (1) year of the event giving rise to the claim, or it is permanently barred.

Article 12: Privacy

Your privacy is important to us. Our Privacy Policy (available at beaconfield.space/privacy) explains how we collect, use, and protect your personal information. By using the Site, you consent to our Privacy Policy.

Article 13: Third-Party Links

The Site may contain links to third-party websites (e.g., payment processors, social media). We do not control these websites and are not responsible for their content, privacy practices, or terms. Links do not imply endorsement.

Article 14: Force Majeure

We shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to:

  • War, terrorism, or civil unrest

  • Pandemics, epidemics, or public health emergencies

  • Government actions or regulations

  • Carrier strikes or transportation disruptions

If Force Majeure occurs, we will notify you and perform our obligations as soon as reasonably possible.

Article 15: Indemnification

You agree to indemnify, defend, and hold harmless Beaconfield Group LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

  • Your violation of these Terms

  • Your misuse of the Site or Products

  • Your violation of any law or third-party rights

Article 16: Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

Article 17: Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and Beaconfield Group LLC regarding your use of the Site and purchase of Products, superseding any prior agreements.

Article 18: Amendments
